For the purpose of these terms and conditions, wherever the context so require ‘You’ shall mean any natural or legal person who uses or browses or registered as member or created an account in Suwanda.lk.

When you use any of the services provided by the Suwanda or uses or browses or provided any information or personal data in the Suwanda.lk including but not limited to, (e.g., Customer Reviews), you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Terms and Conditions and shall be considered as part and parcel of this Terms and Conditions. Membership Eligibility

Use of the Suwanda.lk Website is available only to persons who can form legally binding contracts.   • refers to any website or URL that, in the sole discretion of Suwanda.lk, contains material that is inappropriate for the Suwanda.lk Website or any other Website, contains content that would be prohibited or violates the letter or spirit of these Terms and Conditions.

  • threatens the unity, integrity, defense, security or sovereignty of Sri Lanka, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.
  • shall not be false, inaccurate or misleading;
  • shall not, directly or indirectly, offer, attempt to offer, trade or attempt to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the time being in force.
  • shall not create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers;

You shall not use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Website or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Website or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Website. However, the Site may contain Typographical errors, or other inaccurate information, therefore Suwanda reserves the right to correct, and change and update, re arrange, deletions with our prior notice. This may also relate to price changes or any errors that may have cause the change of such information. In that case Suwanda will not be held responsible or liable for any compensations, rebate, or any such claim by you, the browser or purchaser of such product at that time.

The products and services available on the website, and the samples, if any, that website may provide to you, are for your personal and/or professional use only. The products or services, or samples thereof, which you may receive from us, shall not be sold or resold for any/commercial reasons.

Products, Pricing, Promotion Codes and Payments

Only genuine Cycle Brand products which are directly sourced from our factory are traded at Suwanda

Prices are displayed in LKR.

All images of the products are for illustration purpose only and the delivered product may slightly vary due to the changes made by the production house.

The stocks and prices of each product are subjected to change.

All orders are subject to availability and acceptance by Suwanda.lk. We reserve the right to refuse or cancel any order.

If suwanda is unable to deliver the goods ordered by you in the event of inadequate stocks, you will be notified as soon as possible, and the relevant amount will be deducted from your payment. Either the customer will not be charged for the product that is out of stock or the relevant amount of money will be refunded. However, Suwanda.lk will not be responsible for any form of disappointment that the customer may suffer.

Only one promotion code or gift voucher code can be redeemed against a single order.

Special offer prices will be valid only if the item is purchased at the offer price during the time of the offer. Suwanda. will not offer a refund for items bought at a higher price when it was not on a special offer.

Orders are subjected to extra security checks at the discretion of Suwanda.lk. This may include authentication of Credit/Debit card details and full address. Suwanda.lk reserves the right to request payment to be made by an alternative method or to cancel any order if this information cannot be supplied and authenticated. In instances where it is required that payment is made by cash or a bank transfer, Suwanda.lk reserve the right to allow a time period of 24 hours after the funds are received before the processing of your order is initiated.

Suwanda.lk Warranty

Should you discover any defects in your product, or in case any products purchased / received / availed causes side effects or doesn’t suit you, please note that Suwanda.lk is in no manner responsible for any product damaged caused through transportation informed lapsing 24 hrs on the time of receipt of the goods, sample or such faulty product shall be solely responsible by the purchases if such time period of information is lapsed.

Also, we will not be responsible on misuse of the product without knowledge, or not following the product instruction mentioned in each respective product.

On scenario that should you discover any defects in your product, or in case any products or services purchased / received / availed causes side effects or doesn’t suit you, that please call us or contact us through our website contact link, so that we can arrange a replacement once we receive the returned item.

CANCELLATION POLICY

Cancellation before shipment only valid on orders’ place & delivery in Sri Lanka:

If the order or the item(s) that you want to cancel have not been shipped yet, you can write to our customer support team on customercare@suwanda.lk or call us on 9411778 9888

In such cases, the order will be cancelled, and the money will be refunded to you within as soon as possible depending on the bank/payment gateways / net banking schedule which we cannot predict a specific time after the cancellation request is duly processed by us. A LKR 150 refund charge will be applicable.

Returns will not be accepted under the following conditions:

Product is damaged due to misuse/overuse

Returned without original packaging including, price tags, labels, original packing, freebies and other accessories or if original packaging is damaged

Serial Number is tampered with.

Defective products that are not covered under Seller/Manufacturer’s warranty

Product is used or altered

If request is initiated after 2 business days of receipt of the product to the hand

Free product provided by the brand

Payment

While availing any of the payment method/s offered at Suwanda.lk, Suwanda.lk will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to you due to:

  • Lack of authorization for any transaction/s,
  • Or Exceeding the preset limit mutually agreed by you and between your "Bank/s",
  • Or Any payment issues arising out of the transaction,
  • Or Decline of transaction for any other reason/s.

All payments made against the purchases/services on Suwanda.lk by you shall be compulsorily in Sri Lankan Rupees acceptable the by the Central Bank of Sri Lanka. Suwanda.lk does not accept any other form of currency with respect to the purchases made on Suwanda.lk.

Breach

Without limiting other remedies, Suwanda.lk may limit your activity, immediately remove your information, warn other Users of your actions, immediately temporarily/indefinitely suspend or terminate or block your membership, and/or refuse to provide you with access to the Suwanda.lk website in the event, but not limited to:

  • If you breach the Terms and Conditions or Privacy Policy or other rules and policies, if any;
  • If Suwanda.lk is unable to verify or authenticate any information you provide; or
  • If it is believed that your actions may cause legal liability for you, other Users or Suwanda.lk.

Suwanda may at any time at its sole discretion reinstate suspended Users. A User that has been suspended or blocked may not register or attempt to register with Suwanda.lk or use Suwanda.lk Website in any manner whatsoever until such time that such User is reinstated by Suwanda.lk. Notwithstanding the foregoing, if you breach the Terms and Conditions or Privacy Policy or other ruler and policies, Suwanda reserves the right to recover any amounts due and owing by you to Suwanda and to take strict legal action including but not limited to a referral to the appropriate police or other authorities for initiating criminal or other proceedings against you.

Indemnity

You shall indemnify and hold harmless Suwanda its owner, licensee, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of your breach of this Terms and Conditions, privacy Policy and other Policies, or your violation of any law, rules or regulations or the rights of a third party.

Fraudulent /Declined Transactions

Suwanda reserves the right to recover the cost of goods, collection charges and lawyers fees from persons using the Site fraudulently. Suwanda reserves the right to initiate legal proceedings against such persons for fraudulent use of the Site and any other unlawful acts or acts or omissions in breach of these terms and conditions.

Applicable Law

This Agreement shall be governed by and interpreted and construed in accordance with the laws of Sri Lanka.

Trademark, Copyright and Restriction

This site is controlled and operated by Suwanda. All intellectual property rights including trademarks, copyright and brand names of products and its description are proprietary rights of N R R & Sons Private Limited, Sri Lanka, a wholly owned subsidiary of N. Ranga Rao & Sons Private Limited and the brands are under license to Suwanda. All material on this site, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights that are owned and controlled by Suwanda or by other parties that have licensed their material to us. All materials and contents posted in Suwanda.lk are provided for your personal and non-commercial use. Cancellation of order

All orders are subject to availability and acceptance by Suwanda. Suwanda reserve the right to refuse or cancel any order.

Suwanda reserves the right to cancel any order without any explanation for doing so or under such situation wherein-Suwanda.LK is not able to meet the requirement of the order placed or order so placed/cancelled does not comply with the Suwanda.LK terms & conditions or policy or for any other reason.

However, Suwanda will ensure that any communication of cancellation of an order, so cancelled, is intimated within appropriate time to the concerned person and any applicable refund will be made with in a reasonable time. Apart from the refund, Suwanda or its affiliates are not liable for any claim, damages or liability whatsoever for cancellation of the order.

Cancellations by the Customer

In case of Suwanda receiving e a cancellation request from you and the order has not been shipped, then the said order be cancelled and refund the entire amount. The orders that have already been shipped out by Suwanda will not be cancelled and you will have to check our return policy on those orders. In case of customized products, no cancellations are allowed once the ordered item has been taken up for production. The customer agrees not to dispute the decision made by Suwanda and accept Suwanda decision regarding the cancellation and refund as final and binding.

Limitation of Liability

In no event shall Suwanda or its director, employees, agents, licensee, affiliates be liable for any lost profits or special, incidental, indirect, exemplary or consequential damages of any kind including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses in connection with this agreement, even if Suwanda has been informed in advance of the possibility of such damages.
